DMCA Policy

My App respects intellectual property rights and complies with the Digital Millennium Copyright Act of 1998 ("DMCA"). This policy explains how copyright owners can report alleged infringement and how users can file counter-notifications.

3. Filing a DMCA Takedown Notice
If you believe content on our Platform infringes your copyright, send a written notification including:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to be infringed
- Identification of the material claimed to be infringing, with sufficient information to locate it
- Your contact information (address, telephone number, email)
- A statement that you have a good faith belief that use of the material is not authorized
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
4. Counter-Notification
If you believe your content was removed in error, you may file a counter-notification including:
- Your physical or electronic signature
- Identification of the removed material and its former location
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
- Your name, address, telephone number, and email
- A statement consenting to jurisdiction of federal court in your district (or Walworth County, Wisconsin if outside the US)
- A statement that you will accept service of process from the complainant
5. Repeat Infringer Policy
We will terminate, in appropriate circumstances, users who are repeat infringers. We define a repeat infringer as a user who has been the subject of two or more valid DMCA takedown notices.

Upon receiving a valid DMCA takedown notice, we will:
- Promptly remove or disable access to the allegedly infringing content (typically within 24-72 hours)
- Notify the user who posted the content
- Provide information about filing a counter-notification
Upon receiving a valid counter-notification, we will:
- Forward the counter-notification to the original complainant
- Inform them they have 10 business days to file a court action
- Restore the content within 10-14 business days if no court action is filed

Before filing a DMCA notice, please consider whether the use of your copyrighted material may qualify as fair use under 17 U.S.C. § 107. Fair use factors include:
- The purpose and character of the use (including whether it's transformative)
- The nature of the copyrighted work
- The amount used in relation to the whole work
- The effect on the potential market for the original work
